Are you ramping up your cold calling this year for 2025? What about email marketing? With the new Telephone Consumer Protection Act (TCPA) updates, you’re going to need to make sure you don’t cross the fine line of spamming your prospects. But with our tips in this episode, you can worry less about making a mistake and market to your clients the right way.

Why the New TCPA Updates?

  • It can be pretty disturbing when a random person calls you about a home you just sold, and they know all of your information.

  • The new TCPA updates are designed to help protect consumers' private information and avoid the risk of it leaking.

  • With the new law in place, marketers must have written consent from both parties in order to contact them.

How To Collect Written Consent

  • When someone comes to your website and signs up for your newsletter, they’re giving you written permission to contact them through email marketing.

  • For those interested in collecting consent for cold calling, during meetings, you can use an electronic registry at an open house.

  • Also, make sure to keep a record of those who want to be put on the "do not call" list. Use a calling platform like Redx that shows “DNC” beside the names so you don’t risk spamming them.

Educate Yourself

  • Starting January 27, individuals who are tired of spam calls may be ready to take advantage of the new law.

  • We share some tips to help protect yourself, but it’s on you to train up. Start by going to the National Association of Realtors (NAR) website to learn more about the updates.

"When you're sending out email communication, anything that you're doing that’s hitting the consumer's lap, there needs to be a clear opt-out option. So it needs to be super clear." - Tiffany Klusacek

"Just making sure that they have an easy opt-out where it's visible, accessible, all the things." - Ashlee Jankovich
